PUBLIC OFFER
(sale and purchase agreement)
This public offer (hereinafter — the «Offer») is an official proposal by individual entrepreneur Butkov Vladislav Viktorovich, IE No. 002-2025-169-2921, INN 20405200450483, address: Bishkek, Kalyka Akieva St., 11 (hereinafter — the «Seller»), to an unlimited circle of persons (hereinafter — the «Buyer») to conclude a sale and purchase agreement for goods presented on the website https://yamagataoni.shop (hereinafter — the «Site»).
Placing an order on the Site constitutes full and unconditional acceptance of this Offer.
1. General provisions
1.1. The Offer governs the relationship between the Seller and the Buyer regarding the sale of goods presented on the Site. 1.2. The goods are decorative and souvenir products of the Yamagata brand. 1.3. The Seller reserves the right to amend the Offer without prior notice. The new version takes effect from the moment of publication on the Site.
2. Subject of the agreement
2.1. The Seller undertakes to transfer to the Buyer the goods selected on the Site, and the Buyer undertakes to pay for and accept the goods on the terms of this Offer. 2.2. All images and examples of goods on the Site are demonstrative and may differ slightly from the actual items (handmade work, material characteristics).
3. Order placement procedure
3.1. The Buyer places an order independently on the Site or through a feedback form. 3.2. When placing an order, the Buyer undertakes to provide accurate data. 3.3. The Seller is not liable for the impossibility of delivering the goods if the Buyer provided incorrect data.
4. Price of goods and payment procedure
4.1. The price of goods is indicated on the Site in the relevant sections. 4.2. Payment is made by one of the methods presented on the Site (online payment, transfer, etc.). 4.3. The Seller may change the price of goods until the order is placed. 4.4. The cost of delivery is calculated individually and communicated to the Buyer before payment.
5. Delivery
5.1. Delivery is carried out by transport companies and delivery services across Kyrgyzstan and worldwide. 5.2. Delivery times depend on the country, region, and selected operator. 5.3. The Seller is not liable for delays caused by transport companies or customs authorities. 5.4. The risk of accidental loss of the goods passes to the Buyer from the moment the goods are handed over to the delivery service.
6. Return and exchange of goods
6.1. Return of goods is possible in the manner and within the timeframes established by the Return Policy published on the Site. 6.2. Individual and customized orders are not subject to exchange or return. 6.3. A return for the reason «did not like it» is not grounds for a refund.
7. Liability of the parties
7.1. The Buyer is responsible for the accuracy of the data provided. 7.2. The Seller is not liable for:
- •actions of third parties (delivery services, payment operators);
- •violation of delivery times;
- •incorrect actions of the Buyer that resulted in the impossibility of receiving the goods.
7.3. The Seller is not liable for any indirect losses of the Buyer.
8. Warranties
8.1. Yamagata goods are decorative and souvenir items. 8.2. The goods are not intended for combat use. 8.3. The quality of the item is confirmed by a visual inspection before shipping.
9. Personal data
9.1. Processing of personal data is carried out in accordance with the Privacy Policy published on the Site.
10. Final provisions
10.1. All disputes are resolved through negotiations. If agreement cannot be reached — in accordance with the laws of the Kyrgyz Republic. 10.2. Placing an order constitutes the Buyer's agreement with all terms of the Offer.
