Terms of Use

These Terms of Use (hereinafter — the «Agreement») govern the relationship between individual entrepreneur Butkov Vladislav Viktorovich, IE No. 002-2025-169-2921, INN 20405200450483, address: Bishkek, Kalyka Akieva St., 11 (hereinafter — the «Administration»), and any natural or legal person using the website https://yamagataoni.shop (hereinafter — the «Site»).

By using the Site, the User confirms that they have read this Agreement and agree to its terms.

1. General provisions

1.1. The Site provides the User with access to the product catalog, product information, the ability to place orders, fill out feedback forms, subscribe to a newsletter, and other services. 1.2. This Agreement is a public offer in accordance with the laws of the Kyrgyz Republic. 1.3. Use of the Site constitutes the User's full and unconditional acceptance of the terms of the Agreement. 1.4. All rights to the Site's materials belong to the Administration. Copying, distribution, and any use of the Site's materials without the written permission of the Administration is prohibited.

2. Rights and obligations of the User

2.1. The User undertakes to provide accurate information when placing an order or filling out forms on the Site. 2.2. The User undertakes not to take actions that may disrupt the operation of the Site or harm the Administration or other users. 2.3. The User is prohibited from:

  • •using the Site's materials for commercial purposes without the Administration's consent;
  • •posting false, offensive, or misleading data;
  • •attempting to gain unauthorized access to data or functionality of the Site.

2.4. The User has the right to contact support, receive consultations, clarify information about goods, and place orders in accordance with the Site's rules.

3. Rights and obligations of the Administration

3.1. The Administration has the right to:

  • •change the functionality of the Site;
  • •update the assortment and prices;
  • •restrict the User's access in case of violation of the Agreement;
  • •send notifications, messages, and information related to order fulfillment.

3.2. The Administration undertakes to ensure uninterrupted operation of the Site, except in cases of technical maintenance, force majeure, and other unforeseen situations. 3.3. The Administration is not liable for:

  • •failures of internet service providers;
  • •actions of third parties;
  • •inability to access the Site for reasons beyond the Administration's control;
  • •incorrect actions of the User.

4. Personal data

4.1. Collection, processing, and protection of the User's personal data are governed by the Privacy Policy published on the Site. 4.2. By using the Site, the User consents to the processing of personal data for the purposes provided for in the Privacy Policy.

5. Orders and interaction

5.1. Any placement of an order on the Site constitutes voluntary acceptance of the terms of the Public Offer. 5.2. The User undertakes to carefully check the order details before confirmation. 5.3. The Administration reserves the right to refuse to process an order in cases of:

  • •incorrect data being provided;
  • •signs of fraud;
  • •the User's violation of the terms of the Agreement.

6. Liability of the parties

6.1. The User is responsible for any actions performed using their data. 6.2. The Administration is not liable for:

  • •losses arising from the use or inability to use the Site;
  • •user errors when entering information;
  • •actions of third parties (delivery services, payment systems, etc.).

6.3. All goods presented on the Site are souvenir and decorative items of a collectible nature.

7. Intellectual property

7.1. All Site materials (photos, texts, design, Yamagata brand elements) are protected by copyright law. 7.2. Any copying or publication of materials without the Administration's consent is prohibited.

8. Final provisions

8.1. The Administration may amend the Agreement at any time without prior notice. 8.2. The new version of the Agreement takes effect from the moment of its publication on the Site. 8.3. All disputes are resolved in accordance with the laws of the Kyrgyz Republic.
